Will the insurance company for the person that injured me pay my medical bills?

Who will pay for the damage to my vehicle?
The process of getting your vehicle repaired or replaced varies based on the insurance companies involved and the circumstances of the collision. Ideally, the at-fault party’s insurance company will set up a rental car for you while your vehicle is being repaired, and will pay for your vehicle repairs. Unfortunately, however, sometimes the at-fault driver’s insurance company will not agree to pay for your vehicle damage or a rental car because they are further investigating the circumstances of the collision and have not made their own determination as to who caused the collision. This can be frustrating, especially when you believe the accident is clearly the fault of the other driver. While the insurance company’s opinion is not binding on you in a legal action against the at-fault driver, the insurance company’s investigation into and/or determination on fault does impact the process.
If you have “collision coverage” on your insurance policy, which is insurance that covers damage to your vehicle regardless of who is at fault, you have the option of processing your vehicle damage claim through your insurance coverage. There is often a deductible associated with making a claim under your collision coverage. If the at-fault driver’s insurance company is delaying your claim because they have failed to take responsibility in a timely manner, or the at-fault person does not have insurance coverage, you may choose to utilize your own collision coverage to repair or replace your vehicle. Should you choose this option, your insurance company will often seek reimbursement from the at-fault driver for the damages that they pay. When that occurs, the insurance company providing the collision coverage benefits to you will usually also seek to recover your deductible on your behalf.
